There are 3 sources to buy stamp paper: (a) Sub-Registrar Office (counter purchase), (b) Licensed Stamp Vendor (court compound / tehsil), (c) e-Stamping via the SHCIL portal (Stock Holding Corporation of India) for participating states. Online e-Stamp paper is available in most states (Maharashtra, Delhi, Karnataka, Tamil Nadu, etc.). Print it out and get it attested by a Notary.
What is the notary fee?
Notarial fee per affidavit is Rs 50-200 depending on the state. Court complex Notaries usually charge a fixed rate. Some states (Delhi, Maharashtra, Karnataka) charge Rs 50-100. Bigger cities (Mumbai, Bangalore) charge Rs 150-200. Always take the receipt / register entry number as proof.
Who can attest an affidavit — Notary or Magistrate?
A Notary Public, Executive Magistrate, Sub-Registrar, or Oath Commissioner — all can attest an affidavit. The most common is a Notary Public (available in court complexes). For court matters, an Oath Commissioner or court Notary is preferred. For bank affidavits, typically any Notary works.
How long is an affidavit valid?
The validity of an affidavit depends on its purpose, not the affidavit itself. A lost-document affidavit is usually accepted as fresh for 6 months. An address proof affidavit is usually valid for 3-6 months. An income affidavit needs to be freshly made every financial year. A marriage affidavit is valid for a lifetime (event-based, not time-based).
What happens if false information is written in an affidavit?
A false statement on oath can lead to prosecution under IPC Section 191 (giving false evidence) and Section 193 (punishment for false evidence). Punishment is up to 7 years imprisonment plus a fine. This is especially serious if the affidavit is for court proceedings. Always provide truthful information.
