Stamp Duty is the biggest hidden cost in a property purchase in India (typically 3-8% of the property value). Adding the registration fee (0.5-1.5%), the total transaction cost is 4-10% of the property price. It is governed under the Indian Stamp Act 1899 and state-specific stamp schedules. Mandatory under Section 17 of the Registration Act 1908 for a sale/gift/lease > 12 months.

Circle rate vs Market rate: Stamp duty is always calculated on the higher of (a) actual consideration in the deed, (b) Circle Rate / Ready Reckoner Rate / DLC rate as set by the state. Therefore, if the property fair market value is Rs 60L but the circle rate is Rs 50L, stamp duty is on Rs 60L. It cannot be reduced by under-declaring.

Female buyer concession: Most states provide a 1-2% concession to women buyers — Maharashtra (1%), Delhi (2%), UP (1-2% varies), Haryana (2% urban + 2% rural). On a Rs 50L property that is typically Rs 50K - Rs 1L saved on the stamp duty itself. Note that registering a property in a spouse's name to shift rental income does not usually reduce tax: under the income-clubbing rules (Section 64), income from an asset transferred to a spouse without adequate consideration is taxed back in the transferor's hands. Whether the concession is worth claiming depends on your own situation — confirm the current rate with the state sub-registrar.

Joint ownership: Stamp duty is calculated on the TOTAL value, not the split. The buyer's share does not reduce stamp duty.

What is stamp duty calculated on — circle rate or actual price?
Higher of the two. If the actual sale price > circle rate, stamp duty is on the actual price. If the circle rate > actual (under-declaration suspected), stamp duty is on the circle rate. The State Revenue Dept can also reassess if undervaluation is suspected. Always quote the actual price.
How much concession do female buyers get?
This varies state-by-state. Maharashtra 1%, Delhi 2%, Haryana 2%, UP 1-2%, MP 2%, Rajasthan 1%. Bangalore (Karnataka) and Tamil Nadu offer no female concession. Joint property registered with a female as the first/primary owner gets the full concession. In joint male+female registrations, only the female share is concessional in some states (50/50 split benefit).
What is the registration fee?
The fee for registering property documents at the Sub-Registrar's office. Typically 0.5-1.5% of the property value. Plus a fixed computer processing fee of Rs 1000-3000. Maharashtra 1%, Karnataka 1%, Delhi 1%, Tamil Nadu 4% (highest), UP 1%, Haryana 1.5%, Rajasthan 1%.
Can you get a stamp duty refund?
Yes — in specific cases: cancelled transaction (within 5 years), wrong stamp paper denomination, or excess paid by mistake. Application to the Collector / Sub-Registrar within 6 months. 90% refund is typical (10% deducted as processing). Lost original deed: a duplicate without re-stamping is possible (Sec 31 Stamp Act).
What is the stamp duty on a Gift Deed?
Gift deed of immovable property to non-blood relatives: same as sale deed (5-7%). To blood relatives (spouse, child, parents): concessional 1-2% in Maharashtra, Delhi, Karnataka. Fully exempt in some cases. Tax-wise: a gift to relatives is tax-free for the recipient. For non-relatives, a gift > Rs 50K is taxable as income for the recipient.
