What to master before the exam
- ESOP: the perquisite at exercise = (fair market value on the exercise date − price paid) × shares, e.g. (6,500 − 500) × 100 = Rs 6 lakh; that fair market value becomes the cost for capital gains.
- SGB: 2.50% interest a year (taxable), 8-year term, early redemption after the fifth year; redemption by an individual is not a transfer, but a sale in the market is taxed (12.5% if held over 12 months).
- NPS: 80CCD(1) within the Rs 1.5 lakh limit plus Rs 50,000 under 80CCD(1B) (old regime); employer contribution under 80CCD(2) up to 14% of salary (10% for non-government employees in the old regime); 60% of the corpus is tax-free at closure.
- REITs pass through rental income and SPV interest and dividend to unit-holders (InvITs the same, except rental income); Category I and II AIFs are pass-through except for business income, which the fund pays tax on; Category III AIFs are not pass-through.
- Life insurance maturity is exempt under Section 10(10D) if the premium is at most 10% of the sum assured (policies from 1 April 2012); ULIPs issued on or after 1 February 2021 with premium above Rs 2.5 lakh, and other policies from 1 April 2023 with premium above Rs 5 lakh, lose the exemption.
Exam tip: Part of Module 9 (20 marks). Product-specific rules make easy one-mark questions — SGB redemption, the ULIP and Rs 5 lakh thresholds, NPS deduction limits and AIF pass-through.

Question 1
For computing the perquisite value of shares allotted to an employee under an ESOP, the fair market value (FMV) of the shares is taken as on which date?
- The date of grant of the optionoption देने (grant) की तिथि
- The date of vesting of the optionoption
- The date on which the option is exercisedवह तिथि जिस दिन option का exercise किया जाता है
- The date of allotment of the shares
Show answer & explanation
Answer: C — The date on which the option is exercised
Per the workbook, the perquisite is (FMV on the date the option is exercised − amount paid by the employee) × number of shares. Although tax arises in the year of allotment, the FMV on the allotment date is not relevant, and the FMV on the vesting date is also not considered.
Question 2
Ms. Nidhi was granted 200 ESOPs at an exercise price of Rs. 300 per share. The FMV of the share was Rs. 800 on the vesting date, Rs. 950 on the date she exercised the options and Rs. 1,000 on the date the shares were allotted. What is the value of the perquisite taxable as salary?
Show answer & explanation
Answer: B — Rs. 1,30,000
Perquisite = (FMV on exercise date − exercise price) × shares = (950 − 300) × 200 = Rs. 1,30,000. Using the vesting-date FMV gives Rs. 1,00,000 and the allotment-date FMV gives Rs. 1,40,000 — both wrong per the workbook.
Perquisite = (exercise तिथि का FMV − exercise price) × शेयर = (950 − 300) × 200 = रु. 1,30,000। vesting तिथि का FMV लेने पर रु. 1,00,000 और आवंटन तिथि का FMV लेने पर रु. 1,40,000 आता है — workbook के अनुसार दोनों गलत हैं।
Question 3
When an employee sells shares allotted under an ESOP, the period of holding is counted from ______ and the cost of acquisition is ______.
- the date of exercise; the exercise price paidexercise
- the date of grant; the FMV on the grant dategrant
- the date of vesting; the FMV on the allotment datevesting
- the date of allotment; the FMV on the date of exerciseआवंटन की तिथि; exercise की तिथि का FMV
Show answer & explanation
Answer: D — the date of allotment; the FMV on the date of exercise
The workbook states that the period of holding runs from the date of allotment of the shares (not the date of exercise), and the FMV on the date of exercising the option is taken as the cost of acquisition for computing capital gains.
Question 4
Mr. Arun exercised ESOPs of his listed employer and 1,000 shares were allotted to him. The exercise price was Rs. 100 and the FMV on the date of exercise was Rs. 420 per share. Eight months after allotment he sold all the shares on the stock exchange at Rs. 600 each, paying STT. What is the capital gain and how is it taxed?
- STCG of Rs. 1,80,000, taxable at 20% under Section 111Aरु. 1,80,000 का STCG, धारा 111A के अंतर्गत 20% पर कर-योग्य
- STCG of Rs. 5,00,000, taxable at 20% under Section 111Aरु. 5,00,000 का STCG, धारा 111A के अंतर्गत 20% पर कर-योग्य
- STCG of Rs. 1,80,000, taxable at slab ratesरु. 1,80,000 का STCG, स्लैब दरों पर कर-योग्य
- LTCG of Rs. 1,80,000, taxable at 12.50%रु. 1,80,000 का LTCG, 12.50% पर कर-योग्य
Show answer & explanation
Answer: A — STCG of Rs. 1,80,000, taxable at 20% under Section 111A
Cost = FMV on exercise date = Rs. 420. Gain = (600 − 420) × 1,000 = Rs. 1,80,000. Held for 8 months from allotment (not more than 12 months) and STT paid, so it is STCG taxable at 20% (plus surcharge and cess) under Section 111A. The Rs. 320 per share already taxed as perquisite is not taxed again.
