What this chapter covers
What estate planning is, the constituents of an estate (gross estate, residue, estate debt), the consequences of dying intestate, the elements of a plan (will, trust, power of attorney, living will, nomination) and the succession laws — the Indian Succession Act 1925, the Hindu Succession Act 1956, Muslim personal law and the Married Women's Property Act 1874 — plus mutation.
What to master before the exam
- On intestacy, Hindus, Buddhists, Jains and Sikhs follow the Hindu Succession Act 1956; Christians, Parsis and Jews the Indian Succession Act 1925; Muslims their personal law.
- A Hindu male's Class I heirs (son, daughter, widow, mother and the listed descendants of pre-deceased children — 16 in all) take simultaneously; only if there are none do Class II heirs (father first), then agnates, then cognates inherit; the father is not a Class I heir.
- A Hindu female's property (Section 15) goes first to her sons, daughters and husband, then the husband's heirs, then her mother and father, then the father's heirs, and lastly the mother's heirs.
- Muslim law: a will can dispose of at most one-third of net assets; a wife takes one-fourth without lineal descendants and one-eighth otherwise; where there are sons, each son takes double a daughter's share.
- Under the Married Women's Property Act 1874, a policy expressed to be for the wife and/or children is a trust beyond the husband's creditors; mutation of revenue records is for collecting revenue and is not proof of title.
Exam tip: Module 10 (Chapters 14–15) carries 20 marks. Expect "who inherits?" caselets — learn the Class I list, the order for a Hindu female and the one-third limit under Muslim law.

- Only the distribution of an estate after death

- The accumulation, conservation and distribution of an estateएस्टेट का संचय (accumulation), संरक्षण (conservation) और वितरण (distribution)
Show answer & explanation
Answer: D — The accumulation, conservation and distribution of an estate
The workbook defines estate planning as a process that deals with the accumulation, conservation and distribution of an estate; its overall purpose is to enhance and maintain the financial security of individuals and their families. Transfer of a business is succession planning.
Question 2
Which statement correctly distinguishes succession planning from estate planning, as per the workbook?
- Succession planning is planning for one’s business and takes effect within one’s lifetime; estate planning covers one’s personal assetsसक्सेशन प्लानिंग व्यक्ति के व्यवसाय की योजना है जो उसके जीवनकाल में ही प्रभावी होती है; एस्टेट प्लानिंग व्यक्तिगत संपत्तियों से जुड़ी है
- Both terms mean the same thing and have the same objective
- Estate planning is needed only by those who have a succession plan for a business
- Succession planning takes effect only after death, through a Willसक्सेशन प्लानिंग केवल मृत्यु के बाद, Will के माध्यम से प्रभावी होती है
Show answer & explanation
Answer: A — Succession planning is planning for one’s business and takes effect within one’s lifetime; estate planning covers one’s personal assets
The workbook says the two are completely distinct: succession planning is for one’s business and takes effect within one’s lifetime, while every individual needs a personal estate plan whether or not there is a business succession plan.
Question 3
Investments that are neither mentioned in the Will nor allocated to a trust form part of the:
(Estate debt)
- Testamentary trust
- Residue estateरेज़िड्यू एस्टेट (Residue estate)
- Agnate estate
Show answer & explanation
Answer: C — Residue estate
The workbook lists three categories of estate: gross estate, residue estate and estate debt. The residue estate includes personal items (car, jewellery, furniture), any investment not mentioned in the Will or allocated in a trust, and outstanding payments at the time of death.
Question 4
As per Section 30 of the Indian Succession Act, what does “dying intestate” mean?
- A person dies intestate only if he never wrote any Will in his lifeव्यक्ति तभी intestate मरता है जब उसने जीवन में कभी कोई Will न लिखी हो
- A person is deemed to die intestate in respect of all property of which he or she has not made a testamentary disposition capable of taking effectव्यक्ति उस समस्त संपत्ति के संबंध में intestate मृत माना जाता है जिसका उसने ऐसा वसीयती निपटान (testamentary disposition) नहीं किया है जो प्रभावी हो सके
- A person dies intestate only if his Will was not registeredव्यक्ति तभी intestate मरता है जब उसकी Will पंजीकृत न हो
- A person dies intestate only if he has no Class I heirsव्यक्ति तभी intestate मरता है जब उसके कोई Class I वारिस न हों
Show answer & explanation
Answer: B — A person is deemed to die intestate in respect of all property of which he or she has not made a testamentary disposition capable of taking effect
Section 30 deems a person to die intestate for all property not disposed of by a testamentary disposition capable of taking effect — so intestacy may be total or partial (e.g. an invalid or illegal bequest). Registration of a Will is optional, so an unregistered Will does not cause intestacy.
Question 5
For Christians, Parsis and Jews, the law of inheritance on intestacy is contained in:
- The Indian Succession Act, (Indian Succession Act), 1925
- The Hindu Succession Act, (Hindu Succession Act), 1956
- The Muslim Personal Law (Shariat) Application Act, 1937
- The Married Women’s Property Act, (Married Women’s Property Act), 1874
Show answer & explanation
Answer: A — The Indian Succession Act, 1925
The workbook states that for Hindus, Buddhists, Jains and Sikhs the Hindu Succession Act, 1956 governs intestate inheritance, while for Christians, Parsis and Jews the law of inheritance is in the Indian Succession Act, 1925. Muslim inheritance is based on religious texts.
